Whether or not it is true in real life I don't know, but it is a mistake in this show. In the Law & Order world, Jessica would not be trying a rape case because all rape cases (with few exceptions) are tried by the SVU prosecutor, Casey Novak.

As a former Special Victims Unit prosecutor, it is out of character for Cabot to let someone walk on a rape charge & to be completely unsympathetic about the victim's later suicide.
