House of Cards

Fontana and Green investigate when the body of a young mother who had recently cleaned her life up is found in her apartment, with her five-day-old infant son Nicholas missing. Detectives soon track down Arlene Tarrington and ascertain that the infant she is claiming is hers is really baby Nicholas, but after her lawyers make a claim of post-partum psychosis and another man comes forward claiming to be the child's father, McCoy and Borgia are forced to decide which of the two they would rather lock up for the crime.

This episode appears to be ripped from the headlines of the Bobbi Jo Stinnett case. Stinnett was pregnant when she was murdered by a woman who cut the baby out of her body. Like Arlene, the killer had been pretending to be pregnant for months. In another high-profile case, a woman named Sarah Brady killed an attacker who was trying to stab her and steal her fetus; again, her attacker had falsely claimed to be pregnant. (edit)

McCoy: This defense didn't work with Andrea Yates in Texas, and she drowned five children.

Andrea Yates is the mother who killed her five children and was convicted despite the defense's claim that she was suffering from post-partum psychosis. Interestingly enough, one of the reasons that the conviction was overturned was because a prosecution witness, Dr. Park Dietz, had suggested that Yates' defense was based on a Law & Order episode about a mother who drowned her children and got away with it. No such episode had aired prior to the murders being committed. As of September 2006, Yates had been granted a new trial, in which the jury found her not guilty by reason of insanity. (edit)

Anita Van Buren: So did Scott Peterson.

Scott Peterson was convicted of the killings of his wife Lacey and their unborn son Connor in Modesto, California. At first people were sympathetic to him because he said Lacey had been abducted. The baby that was almost abducted in this episode was also named Connor. (edit)
