It was announced on December 14, 2008 that Avery will not return to the Dallas Stars following his suspension but his contract will still be honored.
On December 5, 2008 the NHL sentenced Avery to a fix game suspension and he also agreed to go to anger management therapy for making a comment that the league found to be unacceptable.
On December 2, 2008 Avery was suspended by the NHL for making a comment that was consider "detrimental to the league or the game of hockey."
Early in the morning on April 30, 2008 Avery was rushed to St. Vincent's Medical Center in Manhattan after suffering a lacerated spleen during a playoff game the previous night against the Pittsburgh Penguins. Although Avery made a full recovery and was released on May 4th, after spending five days in the hospital, his season was over.
