When speaking about the legality of the prior restraint issued against the reporter Ron Wieland, it is mentioned that there is precedent for such a restraint in times of war. The only existing precedent of prior restraint upheld by the Supreme Court is in the case of U.S. v. Progressive Magazine in which a writer reveals how to make a hydrogen bomb. The prior restraint was issued legally, but because the same article was published elsewhere, the restraint became ineffectual so the government asked for the case to be thrown out.
