Episode Recap

Eli and Taylor meet with their client, ex-anchorman Sam Russell, and note he'll have to sign a non-confidentiality agreement that would stop him from doing a tell-all book on Zyre Motors, the corporate sponsor who got Sam fired. Eli knows he resigned but plans to argue that he was forced to because the company demoted him. Sam insists that he's doing what he's doing because his career is about bringing the truth to light.

Matt, Maggie, and Paul Rollins of Posner-Klein meet with Dan Buckley, the company CEO, insists that he has an e-mail from Russell saying he resigned. Maggie warns that Eli won't let Russell settle. Buckley insists he's too busy to take the stand but Paul points out that would be a mistake.

As Russell leaves for the night, Eli sees two gladiators running by. Eli follows them and finds himself watching them fight in an arena. One of the gladiators goes down but rallies and kills his opponent.

The next day, Eli asks Patti to research his visions and she suggests he call Frank. Eli says they're not talking and spots Taylor. She wants to see the internal memos that Maggie obtained in Sonoma, and Eli insists he'll be filing a disclosure motion. He claims he doesn't know why Maggie is made at them. Taylor also suggests Eli talk to Frank. However, she refuses to talk to Jordan when he comes in and makes a hasty exit. Eli offers to be there for Jordan but he says that Eli should worry about the case.

As they go into court, Eli notes that Taylor isn't following her own advice but she insists it's different circumstances. They run into Matt and Maggie and bring up the memos. Maggie warns Eli not to lecture him about ethics and walks off. Matt and Taylor wonder why Maggie is pissed at Eli and they argue over the memos. Taylor reminds Matt they have a 3D ultrasound appointment. Eli confronts Maggie privately and wonders why she's withholding evidence. Maggie insists she's fighting for her clients.

They go to the judge and Maggie asserts that they were all copied to Bay West's attorney was copied and they're all privileged information. Further, they predate when Russell was fired. The judge agrees with Maggie and refuses to entertain Eli's motion. Next, Maggie moves to disqualify Eli on the grounds that he thinks he's a prophet. She claims it will prejudice the jury and gives Eli an unfair advantage. Eli agrees that personal details could prejudice the jury but they all have issues and they all are sleeping with or have slept with each other in the past. The judge refuses to disqualify anyone but tells them all to keep the personal issues out of the courtroom.

KNIB's news director, Ryan Church, testifies that they moved Russell to a morning slot because of ratings. Eli cross-exams and tries to connect Russell's demotion with the fact he ran an expose on Zyre Motors the day before he was moved to a new timeslot. Church claims he has no idea how Zyre Motors reacted to the story but Eli shows that the story they replaced it with was a piece on a bi-lingual bandit.

Maggie and Matt meet with Paul for a strategy meeting and he wants to have Maggie take first chair based on her performance against Eli. Matt gets a call from Taylor saying he's late for the appointment. He tells her he can't make it because of the strategy meeting and Taylor points out she can make it but Matt has a lot more lawyers.

Back in court, Russell testifies about how the news has become corrupted by the desire to make a profit, and he threatened the station's profits. Maggie cross-examines him and notes his q-score has been dropping. Russell points out that anchors in the past didn't rely on q-scores, but she counters by pointing out they lost shows due to corporate pressure.

Taylor and Eli discuss the case back at the office and Taylor figures that Eli rejecting Maggie motivated her. Jordan greets them and they admit the case isn't going well. Eli notices that Jordan is keeping a secret and Jordan finally admits that they're in debt and if they don't win the Russell case and get a big settlement, they'll be out of business.

After a night alone, Taylor wakes up the next morning and discovers that Matt is making her breakfast. He apologizes for missing the sonogram appointment but insists he couldn't bail on his teams. She tells him in confidence that Wethersby-Stone is in danger of going under. Matt suggests that she might come to work for P&K but she refuses to work for a detestable firm.

In court, Buckley testifies that he had to make tough choices but insists it never pandered to Zyre Motors. He defends Russell's move by noting that their evening ratings have gone back up. On cross-exam, Taylor produces a film segment on Kimberly Chavez, Russell's successor. The tape shows her doing a fluff piece and Taylor confirms that Chavez hasn't done any investigative pieces. She also informs the jury that the station ignored a piece on an indictment of their parent company's CEO.

As Eli and Taylor leave the court, Eli finds himself in modern-day Rome talking to a gladiator flirting with Maggie. Eli loses her in the crowd before he can catch up to him. He tells Taylor what he saw and Taylor suggests he loves her. Eli denies it but Taylor notes it's more than platonic affection and everyone knows it except him. Eli concedes the possibility and admits he's been feeling alone lately. Taylor says Maggie's been in front of him all along and he should talk to her.

Back in court, Eli asks to talk to Maggie but the judge arrives. Maggie calls Jesse Bates and Eli objects, noting she wasn't on the witness list. Maggie points out she was listed as a John Doe witness and the judge agrees to allow Jesse to testify. On the stand, Jesse is forced to testify that Church told Russell he might be moved to the morning show six months earlier. Russell didn't say anything six months earlier so he couldn't have believed the move constituted a demotion.

That night at W&S, Eli snaps at Russell for withholding information from them necessary to his defense. Eli insists it's semantic and the jury doesn't understand, but Russell insists that people are smarter than Eli, or Bay West, give them credit for. Russell leaves and Jordan comes in to note that berating clients is bad for business. He offers some help but Taylor abruptly says they don't need him. After Jordan leaves, Eli wonders what Jordan has done that is worth such treatment. She tells Eli how Jordan chased her mother away and Eli concedes she has a right to be wrong. He tells her that he found out who was responsible for his father's death, but Jordan has been trying to make amends. Taylor says that now it's too late and the window of opportunity has closed.

Seizing on Taylor's "window of opportunity" comment, Eli goes back to the judge and informs her that per Jesse's testimony, the demotion was discussed six months ago. With the new timeline, the relevant documents were written after the demotion. The judge orders Maggie to turn over the documents to W&S. Taylor and Eli get back to the office only to discover that Maggie sent all the documents: dozens of boxes. Taylor calls Matt and accuses him of hiding the relevant documents and wonders if that's how he does business. Matt points out her anger might be dad-related, but Taylor points out it relates to whether he's suitable as a dad.

Jordan and Patti help to go through the document boxes but Eli finds the box they're looking for: it's from Gladiator Archival. He calls Buckley back to the stand and shows him the memo that says he told Church to "take care of the problem" with Russell's story. Maggie tries to cover by noting there's nothing specific in the memo, but Eli asks Buckley to say what the problem was. Buckley finally admits that Zyre Motors wanted assurances that Russell couldn't push the story against them. Afterward, Taylor tells Eli to talk to Maggie before she has a chance to think things over. Eli pulls her into an office and gets her to listen to his apology. Maggie admits that she tried to get over Eli, and sleeping with him did the trick. She thanks him for giving her closure and then explains that she's hostile toward him because that's her job as an attorney. She suggests that once the case is over, they go out for coffee… as friends.

Jordan comes in to hear Eli as he gives his summation, noting that the jury needs to send a message that news stations need to live up to their responsibilities. Maggie responds in her summation by agreeing, but pointing out that Russell chose to quit and try to get a big cash settlement rather than fight for change from within.

As they wait for the jury to return with a verdict, Jordan warns that they are unlikely to get enough money to keep the firm going. Eli gets a call from someone asking him to walk down the hall. Matt grabs him and yanks him into a closet. He offers a settlement from Bay West that the rest of his team doesn't know about. Bay West will pay Russell $5 million to publicly say he resigned. Matt also points out that the firm's share will keep them afloat.

Eli takes the deal to Russell, but the former news anchor still wants Bay West to admit they were wrong. Eli warns that he's unlikely to get a big reward from the jury. Russell considers taking it, but Jordan jumps in and says that he should refuse to take the settlement. Jordan insists he needs to stand up for what is right and that if he doesn't, his conscience will bother him for not living up to his personal ethics. Taylor admits her father is right and Russell agrees.

As Eli goes to tell Matt, he finds himself back in a vision of Rome. He sees Maggie and tries to approach her, but sees Paul Rollins arrive and kiss her.

The jury finds in favor of Bay West. Paul holds a celebration and glories in W&S's loss. He congratulates Maggie in particular and sends everyone back to work. However, he calls Matt over in private and tells him never to try that kind of stunt again. Matt walks away.

At W&S, Jordan tries to come up with a way to keep the firm going six months. Taylor assures her father he's not alone, and he's happy to have her on his side again. Matt comes in and asks for his old office: he tells them he couldn't work for P&K any more. He'd like to work at W&S and make up for his own past mistakes. Taylor is happy to have him but Jordan warns they can't pay him. Matt tells Taylor that he wants to make sure his child has a father who will stand up for the things he cares about. Taylor tells Matt that their child is a girl and they embrace.

Eli goes to see Maggie and brings her flowers. He sees her as she gets into a car with Paul Rollins and drives away.
