Luke is awarded joint custody of April.
This is the second time Lorelai has been Luke's character witness. In "The Lorelai's First Day at Yale," when Luke is talking to the lawyers, he asks her to be his character witness to prove that he wants nothing from his divorce with Nicole.
While she's now married, the Judge refers to Lorelai as "Ms. Lorelai Gilmore". Since the Judge does nothing but read Lorelai's letter, we can assume that not only did Lorelai not take Christopher's name (she said she wouldn't, so no surprise there) but it also looks like she's attached to her single status. It can also be interpreted as a way of not hurting Luke.
One unrealistic aspect of the custody hearing is that the judge does not take April's opinion into account. In actual custody proceedings, the child usually must have her own attorney appointed to represent the child's interests, because those interests are not always in line with the interests of her parents. In a situation where the child is old enough to vocalize her wishes, the judge would definitely take those wishes into consideration. Here, April was definitely old enough to have an opinion on the matter, and she clearly wanted Luke to have the partial custody he requested. If this was an actual custody proceeding, the judge would have spoken with April (or her court-appointed attorney) and it would have been another strong factor in favor of granting Luke shared custody. This was probably not incorporated into the episode, because not factoring in April's opinion made the hearing more suspenseful for the audience ... if less realistic.
We find out that Sookie is pregnant in this episode.
When Jackson is talking to Lorelai in his kitchen, he opens the water bottle but then on several shots the cap is still on.
When Lorelai returns home from babysitting, she walks across the yard in the snow. We see clearly that there is snow stuck on the bottom of her shoes as she enters the house from outside. When the camera inside the house catches her entering, she doesn't clean her shoes off yet there is no snow left on the rug and she doesn't slip on the wooden floors.
In Lorelai's reference letter she states that she has known Luke Danes for almost 10 years. This is consistent with the fact that in season 5 episode "Written in the Stars" Luke told her he had met her eight years earlier. Also, in "Santa's Secret Stuff" Luke implies to April that he met Rory when he was her age. It seems unlikely that she didn't know Luke for the first eleven years she lived there. In Season 5, episode "Wedding Bell Blues", after the Luke/Christopher debacle Lorelai said to Rory that Luke still remembered her in angel wings. This implied that her knew her at a very young age...probably 5 or 6 or younger, not 11 or 12.
Just before Lorelai goes over to babysit, she and Christopher have a conversation. Right at the end when they kiss the last time, her arm isn't round his neck but when the shot changes it is.
When Sookie is asking Lorelai to babysit Martha and Davey, her coat is on the chair and she is sitting on it. When she gets up to hug Lorelai after Lorelai says yes, the coat is on the back of the chair and then it goes back to being on the seat of the chair with Sookie sitting on it again.
When Lorelai and Christopher are having their ugly conversation in the kitchen the position of Christopher's zipper changes between shots.
When Rory and Paris are sitting in the cafeteria, Rory's arms are in difference positions between shots.
In this episode, Lucy finally calls Marty by his first name, as opposed to "Boyfriend" -- the label she has given him for the past several episodes.
The police officer or bailiff in the court house in this episode was played by George Anthony Bell, who was also Professor Bell in Rory's class in the season 5 episode "But Not As Cute As Pushkin."
Chris: Hey have you seen the level?
Lorelai: The, uh, thing with the green bubble that goes back and forth?
Lorelai: Yeah, Paul Anka and I were playing with it.
Chris: You were playing with it with the dog?
Lorelai: Yes, I was trying to hypnotize him with the bubble.
Chris: Uh Huh
Lorelai: See if I could talk him out of the habit of chewing on the corner of the welcome mat. Or, I was going to give him a wacky post-hypnotic suggestion like the door bell rings and he spins around in circles.
Chris: Were you able to hypnotize him?
Lorelai: No Chris, he's a dog.
Lorelai: But, you know, babies are more than diapers, though, right?
Sookie: No, no.
Sookie: No, all I remember is eat, sleep, poop, eat, sleep, poop.
Lorelai: Well, there's other stuff.
Sookie: Yeah, like, uh, diaper rash, and colic, and potty training.
Lorelai: No, the good stuff.
Sookie: Well, I'm having trouble remembering that.
Lorelai: Well, for one thing, they're pretty cute.
Sookie: Yeah, well, but, cute's not going to help me sleep at night.
Lorelai: And they smell great. That newborn baby smell, you can't beat that, right?
Sookie: The smell is pretty good.
Lorelai: And how about when you give them their first bath. I remember when I gave Rory her first bath and she looked up at me like, "What the hell is going on?" I kept saying, "I'm sorry, I'm sorry, I'm sorry."
Sookie: You know, Davey loved his first one. Martha screamed bloody murder. Oh, my God, the screaming.
Lorelai: Yeah, but how about the first time they're crying and crying and you go in to pick them up and then they stop crying because they recognize you!
Sookie: That's pretty cool.
Sookie: I'm not going to sleep, though.
Lorelai: Yeah, you won't sleep, but you'll get another first smile.
Sookie: Davey had his at three weeks. That's really advanced.
Lorelai: Aww. And how about when you're lying down, holding the baby, and the baby falls asleep on your chest.
Sookie: And they're all warm and cuddly. God. I know what you're doing. You're trying to make this sound good.
Lorelai: In the middle of the night, and you're rocking the baby, and everyone's asleep. Then they fall asleep, then you fall asleep.
Sookie: (starts to cry) I'm hormonal. And you're playing dirty.
Lorelai: Pretty good stuff, huh?
Sookie: I guess.
Lorelai: Really good.
Sookie: Are you talking memory or are you talking ahead?
Lorelai: Oh, uh, a little bit of both, I guess.
Lorelai: Well, the subject has come up. It might come up again.
(After fighting with Christopher and waking up alone, Luke calls)
Luke: Hey, I didn't wake you did I?
Lorelai: Uh, no, hi. No. I'm up.
Luke: I just had to tell you–-I won!
Lorelai: (confused) You won?
Luke: It's incredible. I thought I was screwed. I mean, her lawyer dug up every last bit of dirt she could find about me, but...
Lorelai: (realizes what he's talking about) Oh, oh, Luke, that's great.
Luke: Yeah, the judge waited until this morning to give us their decision, and man that was the longest night of my life. I just got off [the phone] with my lawyer. I get shared custody.
Lorelai: Wow, congratulations.
Luke: Yeah, I get to see April at least one weekend a month, every other major holiday, half the summer, we're going to work it all out. It's so great.
Lorelai: So great.
Luke: Yeah, I guess the judge just took everything into consideration, and realized how much I wanted to be in April's life. And, of course, your letter was a big help.
Lorelai: (winces) Well, I just wanted to help you–-help April.
Luke: Well, you did, and I'm really grateful. Anyway, sorry to call so early. Uh, thanks again.
Lorelai: Congratulations. (hangs up and sighs)
Chris: I read your letter.
Lorelai: It's not a letter. It's a character reference Luke asked me to write for his court case.
Chris: It reads like a letter.
Lorelai: Oh yeah?
Chris: Almost like a love letter.
Lorelai: (pauses uncomfortably) No, it's a favor Luke asked, because he needed ...
Chris: You know what, before you go through a whole list of excuses, let me just ask.....is our marriage, for you, basically just marking time?
Chris: Oh, come on, Lor.
Lorelai: Of course not!
Chris: I mean, it's obvious that you still have very deep feelings for the guy.
Lorelai: No, no. I've just known him a long time and he's--
Chris: (quoting the letter) "Always been there, always will be there."
Judge: (reading Lorelai's letter) To whom it may concern, in the nearly 10 years that I have known Luke Danes, I have come know him as an honest, and decent man. He's also one of the most kind and caring persons I have ever met.
(Camera cuts to Chris reading the letter and we hear Lorelai's voice.)
Lorelai: I am a single mother, and I raise my daughter by myself, but once Luke Danes became my friend in this town, I never really felt alone. Luke and I have had our ups and downs over the years, but through it all, his relationship with my daughter Rory, has never changed. He's always been there for her no matter what. He was there to celebrate her birthdays, he was there cheering her on at her high school graduation. Luke has been sort of a father figure in my daughters life. With his own daughter Luke wasn't given the opportunity to be there for her first 12 years, but he should be given that opportunity now. Once Luke Danes is in your life, he's in your life forever.
Judge: I know from personal experience what an amazing gift that is, and not to allow him access to his daughter, would be to seriously deprive her, of all this man has to offer, and he offers so much. Thank you for your time, sincerely, Lorelai Gilmore.
Lorelai: (about the letter for Luke) I didn't hide the letter! I put it in the drawer in case they lost the typed copy, or the judge spilled coffee on it, the dog ate it, I don't know why I didn't tell you!
Christopher: I think it's because you're still in love with him.
Lorelai: No, I love you. I love you!
Christopher: You know what, Lor, I'm sorry, but I just can't handle this, okay?
Lorelai: Handle what?
Christopher: This! You, and him, I just, I can't handle being your second choice. I thought I could, but I can't, okay? I can't be your rebound. I'm sorry. (walks out)
Jackson: So, how's Christopher?
Lorelai: Oh he's good. He's putting up a ginormous flat screen as we speak.
Jackson: Cool. What the pixel aspect ratio?
Lorelai: It's got two remotes.
Jackson: I'll ask him.
Lorelai: Good idea.
Richard: (to his students) Now, when it comes to papers, I am guessing that some of you, of course, will be asking me for an extension. You'll be happy to learn that I have no problem with extensions. Here's what you do: you look at the due date for the paper, and you write it down on your calendar two weeks prior to that due date--and there you have it. I've just granted you a two-week extension.
Lorelai: You smell good. Familiar. Is that my conditioner?
Chris: Maybe. I don't know.
Lorelai: Are you using my conditioner?
Chris: Sometimes, why? You don't like to share?
Lorelai: No, I'm married now, I love to share.
Chris: So why is it so funny?
Lorelai: Because you don't have that much to condition.
Chris: I know that.
Lorelai: It's just been really unruly lately?
Chris: Alright, I got a lot of work to do here.
Lorelai: Alright. Listen, I love that you're using my conditioner. And I love that you're putting up this jumbo-tron thingy all by yourself, and I can't wait to come home and watch flat sports with you, and I love you, goodbye.
Chris: I will be here.
Lorelai: Hey if you feel like shaving I've got a brand new Lady Schick in the drawer. Feel free to use it.
Chris: Oh, I might just do that.
Paris: Okay, look. It's time to put an end to this little junior high game you're playing.
Lucy: (taken by surprise) Hey, Paris.
Paris: Have you read Rory's letter or not?
Lucy: Um, yeah, I just--
Paris: Well, will you please tell her you forgive her and kiss and make up already? This is really messing with her head.
Rory: (running up) I'm sorry, Lucy, I didn't--
Paris: Don't apologize. I've got her on the ropes.
Lucy: Look, I just got back an hour ago, so I just read your letter.
Paris: Yeah, and?
Lucy: Well, it's not really fair--I mean, with you being a writer.
Paris: Yeah. Yeah, life's not fair. Can you let her off the hook, for God's sake? In case you didn't know it, Rory is a great person, and she does not deserve to be treated this way!
Paris: Anyone should feel lucky to call her a friend. I know I do--and you're throwing away one of the best.
Christopher: I know you Lor.
Christopher: And I know you're not done with him.
Lorelai: Okay, this is ridiculous. Hey, this is a ridiculous conversation, okay? I have a history with him, yes. I was engaged to him, yes, but I married you!
Christopher: Tell me you're not in love with him.
Lorelai: I am not in love with him.
Christopher: I should have known......I mean, all the signs were there.
Lorelai: What signs?
Christopher: Well, the fact that you didn't want to leave Stars Hollow, that you were dead-set against re-doing the wedding, that you didn't want to have a baby with me! I mean, it's all because of him, right?
Lorelai: No! How can I tell you--it's over, okay? What I had with him is over, Chris.
Chris: Then why did you hide the letter from me?
Sookie: Oh, God, I hope I have a girl, ooh, or a boy!
Lorelai: Well, chances are pretty good that you'll have one or the other.
Richard: So, have you come as a loving granddaughter visiting your grandfather, or as an obsequious student trying to butter up her professor?
Rory: Well, I'm not buttering up.
Richard: Oh, good.
Rory: Well, actually...
Richard: (smiling) A-ha, I thought I smelled butter!
Rory: I'm going through something with a friend.
Rory: No, someone else. I hurt her feelings, and even after writing her a very long letter of apology, she hasn't gotten back to me, and I just feel terrible.
Richard: Well, I doubt it's as bad as you think it is. I'm sure the girl will get back to you. Maybe she's just a very slow reader. (Rory still looks upset) Oh, honey, anyone who knows you knows that you would never purposely do anything to hurt someone else's feelings.
Rory: Well, that's just it. We don't know each other that well. She's a new friend. We don't have a history.
Richard: Hmm. Well, I wouldn't worry about it. Rory, you are a person of great heart and great character, and that combination will always win the day.
Emily: Oh, and Lorelai, it turns out I have an emergency DAR board meeting on Tuesday, so I won't be able to get together to finalize the seating chart for the party.
Lorelai: No seating chart get-together? How will I live?
Luke: (making conversation with Anna at the courthouse) So...this place, huh?
Anna: Yeah, what a waste of time.
Anna: Especially since there's no reason for it.
Luke: Well, I mean--
Anna: But you have to finish what you started, right?
Luke: What I started?
Anna: Uh, yes, when you hired a lawyer.
Luke: Well, I had to hire a lawyer. It was the only way I could see my kid.
Anna: But I mean, come on--you really think you have a chance?
Luke: Yeah, well, that's for a judge to decide.
Anna: Well, step back. Take a look at it. I mean, look at you. You're you--a hermit, living above a diner in some old, converted hardware store. It doesn't exactly paint a picture of "capable father."
Luke: It doesn't matter where I live, and I have been nothing but a good father to April.
Anna: And you know what, you're not gonna get any points for your history with women, either.
Luke: I don't know what you're talking about.
Anna: Bailed on Lorelai, got divorced in a heartbeat--
Luke: I did not bail on Lorelai!
Anna: You have had no long-term relationships, Luke. Why would a judge trust you to have one with April?
Jackson: (talking to Lorelai about Sookie) She's pregnant!
Lorelai: Well, I know that and you know that but don't you think we should let Sookie in on the good news?
Melissa McCarthy (who plays Sookie) is actually pregnant with her first child during this on-screen pregnancy.
