Judge MacBride corrected Fonzie for "passing" rather than "waiving" his opening remarks. However, Fonzie's incorrect word selection was trivial compared to several errors she let stand. For example, the plaintiff sat to the right of the judge and the defense sat to the left, the defense called a witness before the plaintiff rested, and Judge MacBride permitted discussion of the Fifth Amendment (protection against forced self-incrimination) during a civil (non-criminal) proceeding.
