Earl was convicted in a state court at the county level for the crime of kidnapping and false imprisonment, which are state charges unless a state line is crossed thus bringing those crimes under Federal jurisdiction. In this episode we find out that Earl has been sentenced to a Federal prison, based on Randy's uniform which clearly reads Federal Department of Corrections. A state judge has no authority to sentence anyone to a Federal lockup for a state crime. Earl would have had to have been tried in a Federal court, which he clearly was not.
The warden is seen playing "Guitar Hero III" (as seen on the distinctive wireless guitar) before he is given the job with the National Guard, which was dated September 10, 2001. "Guitar Hero III" was not released until October 2007. The first "Guitar Hero" was released in 2005.
