Sprows: Two years ago, the Court had a chance to overturn this very law. It was 4-4 to grant cert on the challenge to the ban on gay adoption.
Garza:: And you told me to take the case.
Sprows: And you voted not to.

The Supreme Court uses the "rule of four" to decide when to "grant cert" (grant a writ of certiorari, agreeing to hear the case). Once four justices voted to grant cert, it wouldn't have mattered how Garza voted.
