Kingsfield ends class by reminding his students about the upcoming midterm and fields questions regarding the exam: Q: Will you give us any guidelines regarding the scope and nature of the questions on the Exam? A: No. Q: May we safely assume…. (cut off) A: You may not safely assume anything in my class. Q: Will landmark cases make up the bulk of the exam? A: Absolutely not. Jonathan Brooks tells Kingsfield that he has spent a lot of time studying the famous cases. Kingsfield retorts that they need to study everything because he might test them on anything. He wants them to be able to apply and analyze what they have studied, not just regurgitate facts: "I am testing minds, Mr. Brooks, not memories."
Jonathan runs from class and calls his tutor and, for twice his normal fee, agrees to give Jonathan the extra time he wants. Meanwhile Hart, and the other members of the study group, while wondering why Jonathan isn't preparing with them, are going crazy because of all of the other pandemonium around campus.
To get some quiet space to study, Hart finds a couple of rooms in a local upscale hotel, The Winston Arms. The study group fills up the two rooms with study stuff and room service, seriously depleting the hotel's supply of dishes. Jonathan, whose tutor has quit on him, turns up at the hotel and tries to get Hart to tutor him. Jonathan pleads that, although he can memorize just about anything, he needs Hart's help with the analysis. Hart wants to help, but can't spare the time to work one-on-one and asks Jonathan to stay and join in with the preparations of the rest of the study group. The other members of the study group reluctantly let Jonathan come in. Jonathan tries, but, after his request to review the same case for a third time tempers run short and Bell tells him that he is not going to pass no matter what he does and should stop wasting their time. Jonathan leaves in a huff.
Hart looks around for Jonathan and finds him sitting by himself. Hart lets him know that the rest of the study group is sorry and they want him to come back. Jonathan agrees to come, but needs to wait for something first and will be along in a half an hour.
Jonathan arrives at the hotel with a manila envelope in his hands and pays a porter ten dollars to come up to the room later and deliver the envelope to "Mr. Brooks". When the porter delivers it, Jonathan says that he was expecting it, that it was some old Kingsfield exam questions that he paid his tutor to find. All but one are cases that the group had already studied, but one, Flowers vrs. Bowling Green Funeral Home, is not. Jonathan says that his tutor's note claims that it is an old case from a 1948 Kingsfield exam. Jonathan laments that the facts of the case are all there, but he needs help with the analysis. The rest of the study group jump in and start taking the case apart.
The group is very pleasantly surprised to find that the one and only case on the midterm is indeed the Flowers case. They all, including Brooks, get an A on the midterm which excites them but causes talk among the other students. This talk bothers Logan most of all and feels that Hart should talk to Jonathan to confirm that everything was indeed above board. Hart doesn't want to believe it, but when Jonathan falls down in class again, Hart knows he needs to clear his own conscience. Hart asks Jonathan for the name of his tutor. After giving him the name Woodrow Tullis, Jonathan wants to know why Hart is interested. Hart refers to the fact that Tullis was able to give them the exact question on the test. Jonathan blows up at the implication that he is a cheat and stalks out.
Hart comes across Tullis at Ernie's and asks about the exam questions. Tullis didn't give Jonathan the actual test question but tells Hart that he asked for it. Hart confronts Jonathan who, after initially punching Hart, admits to having bought the test. He confides in Hart that he never wanted to be a lawyer, did it to please everyone else. He tells Hart that he is going to disappear and not give Hart anymore problems. Hart tells him that he needs to tell Kingsfield, but Brooks only wants to run away.
According to the "Canon of Ethics" of the school, every member of the study group is guilty of cheating if they don't let Kingsfield know that Brooks cheated.
Jonathan calls Hart and asks him to meet him at Kingsfield's office. He explains to Hart that he couldn't run away from himself and will tell Kingsfield what happened. In the encounter between Jonathan and Kingfield, Jonathan comes to the realization that he has learned to not be afraid of what other people think.
